UPDATE: Joint Committee on Medical Marijuana

Implementation of Section 381.986(4)(b), F.S. (2017)

On August 3, 2017, the Board of Medicine and Osteopathic Medicine’s Joint Committee on Medical Marijuana discussed implementation of section 381.986(4)(b), F.S. (2017), which provides that if a qualified physician issues a physician certification for a qualified patient diagnosed with a qualifying medical condition the physician must submit specified information to the Board of Medicine or the Board of Osteopathic Medicine within 14 days after issuing the physician certification. The Committee members agreed that a form is needed so that information provided is consistent. The Committee intends to make the form simple, as it will only identify the requirements for the submitted documentation. When approved, it may be available online as a fillable pdf.

The Committee will continue its work at the Board of Osteopathic Medicine meeting August 25, 2017. Recently, Senate Bill 8A became law upon the signature of the Governor.  The law directs the Boards of Medicine and Osteopathic Medicine to adopt rules for a standardized consent form to certify patients for medical marijuana use. To accomplish this, the Boards of Medicine and Osteopathic Medicine have selected emergency rule committee members to begin work.

Medical Doctors and Doctors of Osteopathic Medicine will be held to practice standards currently in place and new practice standards as soon as they’re adopted. We will provide regular updates through the board website as we move through this process.
